Fair Use Policy


BeMe – Terms & Conditions

By creating an account, subscribing to any plan, or using BeMe in any way, you ("you", "User", "Customer") acknowledge and agree that you accept these Terms & Conditions and our Privacy Policy.

If you do not agree, you must not use the Service.

1. ABOUT BEME

BeMe provides AI-powered call handling, neural and standard voice agents, reasoning, message management, and automation services.

2. THE SERVICE

BeMe provides an AI Twin — your automated digital representative — which delivers:

  • AI voice agent services for answering and handling calls

  • Standard and Neural voice options (the specific voice provided depends on your subscription configuration)

  • Multi-channel message handling, including email, SMS, WhatsApp, Messenger, Instagram, and other supported channels

  • Reasoning, memory, and task automation

  • Calendar and booking integrations

  • Personalised assistant behaviours aligned to your preferences

  • Unified communication support across supported channels

The AI Twin acts as your automated digital representative, capable of responding to callers, processing messages, handling enquiries, taking bookings, and assisting with day-to-day communication tasks.

Service features may be improved or expanded over time.

3. ACCOUNT REQUIREMENTS

You must:

  • Be at least 18 years old

  • Provide accurate information

  • Keep your login details secure

  • Not share your credentials

  • Comply with all applicable laws

We may suspend or terminate accounts for violations.

4. SUBSCRIPTIONS & BILLING

BeMe subscriptions may be purchased through:

  • Stripe (website)

  • Apple App Store

  • Google Play Store

4.1 App Store Billing Override

If you subscribe through Apple or Google, the app store's billing terms — including cancellation and refund rules — override any conflicting terms in this document.

4.2 Billing Cycles

You may choose monthly or annual billing.

Subscriptions renew automatically unless cancelled before the next billing date.

4.3 Cancellation

You may cancel any time via the appropriate billing portal.

Cancellation takes effect at the end of the current billing period.

No refunds for unused time.

4.4 Data Export Requests

To export your data, you must request it via email to support@justbeme.ai at least 7 days before cancellation takes effect.

Data will be provided without undue delay and within legally permitted timeframes.

4.5 Taxes

Prices may be subject to applicable taxes.

5. ANNUAL BILLING

5.1 Upfront Payment

Annual plans charge the full 12-month fee upon purchase.

5.2 Non-Refundable

Annual plans are non-refundable.

5.3 Upgrades

Upgrades may be made at any time. Unused value is prorated automatically.

5.4 Downgrades

Downgrades take effect only upon renewal.

6. MONTHLY PLANS

Monthly plans renew each month until cancelled.

Cancellation stops future charges but does not refund the current month.

7. PRICING CHANGES

We may change subscription prices or features.

If changes materially affect you, we will provide reasonable notice.

Continued use after notice constitutes acceptance.

8. FAIR USE POLICY

8.1 Voice Minutes

Plans include a monthly allowance of AI voice minutes.

If usage significantly exceeds the allowance, we will contact you to discuss options, which may include:

  • Upgrading to a higher tier

  • Temporary limitation of voice functionality

  • Usage restrictions until renewal

8.2 Reasoning & Message Load

Excessive system usage may require an upgrade or may be limited.

8.3 Prohibited Use

You may not use BeMe for:

  • Spam

  • Illegal or fraudulent activity

  • Harassment

  • Auto-dialling at scale

  • Dangerous or regulated communications

  • Reselling BeMe without permission

Violation may result in suspension.

9. DATA PRIVACY & SECURITY

9.1 Your Data — Never Shared, Never Sold

BeMe does not sell, share, rent, or monetise customer data.

9.2 Privacy Policy

By using BeMe, you also agree to our Privacy Policy at www.justbeme.ai/privacy

9.3 You Are the Data Controller

You are responsible for compliance with privacy laws for your customers' data.

9.4 Data Deletion

You may request deletion at any time.

Deletion timelines follow our Privacy Policy.

10. CALL RECORDING & TRANSCRIPTION

BeMe records calls for service delivery, support, and quality assurance.

You are responsible for notifying callers that:

  • They are speaking with an AI assistant

  • The call may be recorded

  • Complying with applicable recording consent laws

You should include appropriate notice in your welcome message or greeting.

11. SERVICE LIMITATIONS & AVAILABILITY

11.1 Availability

BeMe is provided "as is" and "as available".

Uptime is not guaranteed.

11.2 AI Limitations

AI may occasionally generate incomplete or inaccurate responses.

You should verify critical information independently.

BeMe makes no warranty regarding AI accuracy and is not liable for decisions made based on AI output, except where liability cannot be excluded by law.

11.3 Emergency Services

DO NOT USE BEME FOR EMERGENCIES

BeMe cannot contact emergency services (911, 999, 112, etc.).

You must maintain access to traditional phone services for emergencies.

12. OUTBOUND ACTIONS

BeMe may send on your behalf:

  • Emails

  • SMS messages

  • WhatsApp/Messenger responses

  • Voice replies

  • Calendar updates

You are responsible for ensuring your use complies with:

  • GDPR/UK-GDPR

  • TCPA (US)

  • Anti-spam laws

  • Local telecom requirements

13. SUSPENSION & TERMINATION

We may suspend or terminate your access if:

  • Payments fail

  • You violate Fair Use

  • You misuse the service

  • You threaten platform integrity

You may cancel at any time via your billing portal.

14. REFUNDS & CHARGEBACKS

14.1 Monthly Plans

No refunds for partial months.

14.2 Annual Plans

Non-refundable.

14.3 Add-Ons

Non-refundable once activated.

14.4 Chargebacks

If you initiate a chargeback for a validly billed subscription:

  • Your access may be suspended or terminated

  • Outstanding balances remain due

  • Reinstatement is not guaranteed

15. LIABILITY LIMITATIONS

BeMe is not liable for indirect, incidental, special, or consequential damages.

We are not responsible for lost business, missed calls, or AI errors.

Total liability is limited to the amount you paid in the previous 12 months, except where liability cannot be excluded by law.

16. INDEMNITY

You agree to indemnify BeMe against claims arising from:

  • Illegal use

  • Telecom violations

  • Misuse of outbound actions

  • Incorrect data you provide

  • Breach of these Terms

17. NO RESALE

You may not resell, sublicense, or redistribute access to BeMe without written permission.

18. LICENCE TO USE THE SERVICE

You are granted a limited, revocable, non-exclusive, non-transferable licence to access and use BeMe.

No ownership rights are transferred.

19. FORCE MAJEURE

We are not liable for events beyond our reasonable control.

20. CHANGES TO TERMS

We may update these Terms periodically.

Material changes will be communicated in advance.

Continued use constitutes acceptance.

21. GOVERNING LAW

These Terms are governed by the laws of the Isle of Man.

Disputes shall be resolved exclusively in IoM courts.
